These Terms of Use govern the use of the DigiLa online platform and the services, features and content offered through it. By using DigiLa, creating a user account or agreeing to these Terms of Use, the user confirms that they have read and understood the terms and undertake to comply with them.
Additional special terms, set out in appendices to these Terms of Use, may apply to certain services, features, projects or user groups.
1. The DigiLa service
DigiLa is a digital online platform intended to support children's development, learning and the management of development-related information. Depending on the service or user role available to the user, DigiLa may include, among other things, learning materials, educational videos, activity ideas, articles, curriculum-related content and features supporting the monitoring and documentation of children's development.
The content, features and ways of using DigiLa may vary according to the user's role, manner of use, service plan, project or access granted to the user.
DigiLa is not a medical or healthcare service, a diagnostic tool or an individual counselling service. DigiLa's content, assessments, recommendations and other outputs do not replace the assessment or advice of a doctor, speech therapist, psychologist, special education teacher or other qualified professional. If there are concerns about a child's health, development or well-being, a qualified professional should be consulted where necessary.
2. Users and access
DigiLa may be used by individuals and organisations to whom DigiLa, or an institution or other contractual partner working with DigiLa, has granted access.
Depending on the service, users may include parents, guardians, teachers, specialists, employees of an institution or other authorised persons.
Users may use DigiLa only within the scope of their assigned role, rights and access. Different features and data may be available to different user roles.
If a user accesses DigiLa through an institution or other contractual partner, the instructions, agreements and privacy terms of that institution or partner may apply in addition to these Terms of Use.
3. User account
If a user account is required to use DigiLa, the user is responsible for ensuring that the information provided when creating and using the account is accurate, complete and up to date.
Users must keep their account, authentication methods and login credentials secure and prevent their use by unauthorised persons. Any suspected unauthorised use of an account or login credentials must be reported to DigiLa as soon as possible at digila@digila.eu.
DigiLa may restrict, suspend or terminate a user's access if the user breaches these terms, uses the service unlawfully or in a harmful manner, no longer meets the access requirements, or if such action is necessary to protect the security of the service, users, children or data.
Access may also end if the user's relationship with the institution or other party through which access to DigiLa was granted comes to an end.
4. Data and content entered by users
Where DigiLa allows users to enter data about a child or another person, users may enter only data that they are entitled to enter and process and that is relevant to the purpose for which DigiLa is used.
Depending on the feature used, such data may include, for example, a child's name or alias, date of birth or age, development-related notes, assessments, observations and other information entered by the user.
Users must not knowingly enter inaccurate, excessive, inappropriate or unlawful data or content into DigiLa, or data or content unrelated to the purpose of the service.
Users are responsible for the lawfulness of the data and content they enter into DigiLa to the extent that this is within their control.
5. Learning content and child safety
Learning materials, educational videos, activity ideas and other content supporting children's development available through DigiLa are intended to be used in accordance with the purpose and instructions of each material.
When selecting or carrying out an activity described in DigiLa with a child, users must take into account the child's age, skills, developmental level, health, environment and other relevant circumstances.
When carrying out activities with a child, the responsible adult must ensure appropriate supervision and safety for the child.
DigiLa may develop, change, supplement or remove learning content and other materials.
6. Development monitoring and assessment features
Depending on the service and user role available, DigiLa may offer features for recording, monitoring, assessing or summarising information about a child's development, skills or learning.
Notes, assessments, overviews and summaries created through these features are aids to monitoring and supporting a child's development. They do not constitute a standalone diagnosis or a definitive expert assessment.
A child's development should be assessed holistically, taking into account different situations and sources. A single activity, record, assessment, video or other item of information in DigiLa may not provide a complete picture of a child's development.
If a professional assessment of a child's development or well-being is needed, a suitably qualified specialist should be consulted.
7. Use of artificial intelligence
DigiLa may offer AI-based features in certain services or features, or to certain user roles.
Where AI is used to generate, for example, text, recommendations, summaries or other output, that output is generally intended to assist the user and should be reviewed and evaluated by a person before use where necessary.
AI output may contain inaccuracies or require further work and must not automatically be treated as correct, complete or a professional expert assessment.
DigiLa does not use AI to make independently legally binding or otherwise final decisions about a child, unless users have been clearly informed otherwise in relation to a specific feature and such use is permitted by law.
The special terms for a particular service or project may provide that AI-based features are not used in that service or are used only to a limited extent.
8. Feedback
DigiLa may ask users for feedback on the service's ease of use, features, content, learning materials, technical issues and development needs.
DigiLa may use feedback provided by users to analyse, improve and further develop the service.
DigiLa may also use aggregated or anonymous information derived from feedback that cannot identify a user or child to present the service and in communications, presentations and marketing materials.
A user's or child's name, photograph, exact quotation or other feedback that could identify a user or child will be used in public communications only where the necessary consent or other appropriate legal basis exists.
9. Rights to DigiLa content and prohibited activities
DigiLa's learning materials, educational videos, texts, images, design, curriculum-related materials, software and other content available through DigiLa belong to DigiLa, its licensors or partners, unless otherwise stated alongside the relevant content.
Users may use DigiLa content within the scope of the access and usage rights granted to them and in accordance with the purpose of the service.
Without the permission of DigiLa or another rights holder, users may not extensively copy, distribute, publish or resell DigiLa content, turn it into a standalone commercial product, or use it to create a competing service, training course or collection of materials, except where such use is permitted by law or by DigiLa.
Users must not, among other things:
- use another person's account without authorisation;
- damage, disrupt or attempt to circumvent DigiLa's security or access measures;
- collect data about other users or children without the necessary legal basis;
- use DigiLa in a manner that harms a child, other users, DigiLa or third parties;
- use DigiLa for unlawful purposes.
10. Personal data
DigiLa processes personal data in accordance with applicable data protection requirements and DigiLa's Privacy Notice.
Depending on how DigiLa is used and the particular processing involved, DigiLa may act as a data controller or as a data processor on behalf of another organisation.
If DigiLa is used through an institution or other organisation, that organisation may be the controller of certain personal data processed in DigiLa and may determine the purposes and legal bases for processing that data. In such cases, the organisation's Privacy Notice may also apply to the user.

11. Ending access, deleting accounts and retaining data
Users may stop using DigiLa through the account or service management options available to them or, where necessary, by contacting DigiLa or the institution that granted them access.
If an account deletion option is available to the user in DigiLa, the user may use it. Deleting an account or ending access terminates the user's right to use DigiLa through that account or access.
Accounts, access and data are deleted or retained in accordance with DigiLa's Privacy Notice, applicable law, technical capabilities and, where relevant, the agreement between DigiLa and the institution or other organisation concerned.
The end of access or deletion of an account does not necessarily mean that all data held in DigiLa is deleted immediately. Retention of certain data may be necessary under applicable law, for the purposes of processing, to protect rights, for security reasons or in accordance with the controller's instructions.
12. Service availability and liability
DigiLa makes reasonable efforts to keep the service operational, usable and secure but cannot guarantee uninterrupted or completely error-free operation.
Use of the DigiLa service or any of its features may be temporarily restricted due to, among other things, maintenance, updates, technical failures, security incidents, failures of third-party services or circumstances beyond DigiLa's control.
DigiLa is liable to users on the grounds and to the extent provided by applicable law.
To the extent permitted by law, DigiLa is not liable for harm to the extent that it is caused by the user's own acts or omissions, including knowingly providing incorrect information, sharing account credentials without authorisation, using the service contrary to these terms or disregarding DigiLa's instructions.
These terms do not limit DigiLa's liability or users' rights where such limitation is not permitted under applicable law.
13. Special terms and appendices
Additional special terms may apply to certain DigiLa services, features, projects, service plans or user groups. These may be set out in appendices to these Terms of Use or made available to users in another clear manner.
Where a particular appendix applies to a user, it forms part of these Terms of Use.
If an appendix differs from the general Terms of Use in relation to a particular service, feature or project, the special terms of that appendix apply in that respect.
14. Changes to the terms
DigiLa may amend these Terms of Use where there is a justified need to do so, including due to the development of services or features, changes in law or its interpretation, data processing, security requirements or DigiLa's operations.
The current version of the Terms of Use will be made available to users on the DigiLa online platform or by other appropriate means.
If a change to the Terms of Use materially affects users' rights or obligations, DigiLa will notify users of the change within a reasonable time before it takes effect, where necessary and possible in light of the circumstances and applicable requirements.
Changes to an appendix for a particular project or service do not require changes to the general Terms of Use if the changes concern only the service or project governed by that appendix.
15. Governing law and contact
These Terms of Use are governed by Estonian law, subject to any rights users have under mandatory provisions of law applicable to them.
The parties will first seek to resolve disputes by agreement. If no agreement is reached, disputes will be resolved in accordance with applicable law.

Appendix 1 – Special terms for the Pisi-DigiLa pilot project
This Appendix 1 forms part of the DigiLa online platform Terms of Use and applies only to users participating in the Pisi-DigiLa pilot project.
The general Terms of Use for the DigiLa online platform apply to the use of Pisi-DigiLa together with the special terms set out in this appendix. Where this appendix contains a term for Pisi-DigiLa that differs from the general Terms of Use, this appendix applies to the use of Pisi-DigiLa.
1. The Pisi-DigiLa pilot project
Pisi-DigiLa is part of the DigiLa service and, during the pilot project, is intended primarily for parents of children aged 12–18 months or other persons responsible for a child.
The Pisi-DigiLa pilot project runs from August 2026 to May 2027, unless DigiLa announces a change to its duration.
The aim of the pilot project is to test and develop Pisi-DigiLa's content, features, usage flows and user experience, and to collect feedback from users to further develop the service.
2. Development of the service during the pilot project
Pisi-DigiLa is a service under development during the pilot project. As a result, the following may, among other things, change, be added or be removed during the pilot:
- service content and learning materials;
- features and how they are used;
- design and user interface;
- usage flows;
- activities and materials available to users;
- technical solutions;
- access arrangements.
DigiLa may make such changes to test and develop the service, take user feedback into account, resolve technical issues and ensure the security and reliability of the service.
Changes made during the pilot project may not be available to all users at the same time.
3. Access to Pisi-DigiLa
Access to Pisi-DigiLa is granted to users participating in the pilot project in accordance with the access conditions set by DigiLa.
During the pilot project, users may use a Pisi-DigiLa account until the child reaches 18 months of age and for up to three months thereafter.
After that period, access to Pisi-DigiLa may end, or users may be granted access to another DigiLa service under the terms in force at that time.
Use of Pisi-DigiLa does not automatically entitle users to access other DigiLa services, age groups, materials or features.
4. Free use during the pilot project
Pisi-DigiLa is free for users during the pilot project.
At the end of the pilot project, Pisi-DigiLa and other DigiLa services will not automatically become paid services for users.
If DigiLa offers paid access to Pisi-DigiLa, other age groups, materials, features or other DigiLa services in the future, users will be given the price and terms of the relevant service before ordering or activating a paid service.
Use of a paid service requires the user to separately agree to the relevant offer and terms.
5. AI features
The Pisi-DigiLa pilot project does not use an AI-based feature to generate a summary of a child's developmental assessment.
The principles set out in DigiLa's general Terms of Use apply to the use of AI-based features in other DigiLa services.
6. Feedback on the pilot project
As part of the pilot project, DigiLa may ask users for feedback on, among other things, Pisi-DigiLa's content, ease of use, features, activity ideas, learning materials and development needs.
Providing feedback is voluntary unless users are clearly informed otherwise in connection with a specific study or activity.
The principles set out in DigiLa's general Terms of Use and Privacy Notice apply to the processing and use of feedback.
7. End of the pilot project
At the end of the pilot project, DigiLa may decide to continue, change, expand or discontinue the Pisi-DigiLa service.
Participation in the pilot project does not guarantee that Pisi-DigiLa will be offered after the pilot in the same form, with the same features or on the same terms.
If the terms for using Pisi-DigiLa change materially after the pilot project, users will be informed of the new terms before they apply.
